Michael Cunha’s Judgement establishes strongly
Illegal Beach Sand Mining Baron S.Vaikundarajan
is Jayalalitha’s Benami
Judge Michael Cunha’s Judgement on the Disproportionate Assets case has brought to light very clearly that S.Vaikundarajan who is involved in large scale illegal mining in the southern districts of TamilNadu is Jayalalitha’s Benami. Cunha’s Judgement has established 32 benami companies through which Jayalalitha accumulated huge assets by diverting her ill gotten money. One such company is Riverway Agro Products Pvt Ltd through which Jayalalitha bought 1190 acres of land in the Thoothukudi/ Thirunelveli districts of Tamilnadu in the year 1994. The Judge has ordered for confiscation of all lands bought through such illegal means including this. What the outside world does not know is that, Mr.S.Vaikundarajan, the illegal beach sand mining baron is the Director of Riverway Agro Products Pvt Ltd from the year 2003 till date [Annexure 1] and hence is the custodian of the entire 1190 acres of land of Ms Jayalalitha.
Jayalalitha made various efforts to save her benami S. Vaikundarajan and his company V.V.Minerals over the last 1 year. Ashish Kumar, the then collector of Thoothukudi conducted a raid on V.V.minerals on August 6, 2013 and found out that V.V.Minerals has been involved in large scale illegal mining. While the permission was granted for mining on 4 hectares, V.V.Minerals was found to be mining on 30 hectares in the Vaipar redion [Annexure 2]. After the collector brought this to light, Jayalalitha immediately intervened and transferred the collector on August 8 to save Vaikundarajan. Now it is obviously clear that she was not only saving Vaikundarajan by misusing her power. To divert the attention, she formed an enquiry committee headed by Gagandeep Singh Bedi. The enquiry report of Mr Bedi has neither been made public nor has been acted upon.
Further, 20 days ago, when the high court appointed Mr Sagayam, IAS to probe the illegal mining in the state, the state government headed by Jayalalitha immediately appealed in the Supreme Court to cancel the appointment. This was yet another case of Jayalalitha trying to misuse her power to save the mining baron and his large scale illegal mining. This raises a very pertinent question of whether Jayalalitha did the above only as a quid pro quo for S.Vaikundarajan acting as her benami in Riverway Agro Products and Sasikala’s MIDAS Distilleries or does she have a bigger role in the illegal beach sand mining ?? It is important to understand that the value of the rich minerals present in the southern coastal districts of Tamilnadu is 720 times that of the 2G scam.
Aam Aadmi Party has already brought to light the various financial links between Vaikundarajan and Jayalalitha and how Vaikundarajan and his family owned 87% shares in Sasikala’s company ‘MIDAS Golden Distilleries Private Ltd’ until 2009 [Annexure 3]. There have been several financial transactions between Jayalalitha and Vaikundarajan in the past. As of 2006 annual report of Jaya Finance and Investments owned by Illavarasi (Jayalalitha’s benami), Jayalalitha owned companies (as mentioned in Cunha’s Judgement) Dr Namadhu MGR and Jaya Publications have transferred 2.67 crores and 4.78 crores respectively to Jaya Finance and Investments [Annexure 4]. Jaya Finance and Investments have further transferred Rs 3.07 crores and Rs 35.5 lakhs to Fancy Transports Private Limited and Maruthi Transports Private Ltd respectively both of which are completely owned by Vaikundarajan and his family [Annexure 5]. Aam Aadmi Party also brought out the 11 other companies such as Jaya finance and Investments and MIDAS which are controlled by Jayalalitha in April 2014 apart from the 32 benami companies mentioned in the Cunha Judgment.
In TamilNadu, Jayalalitha and her benamies have continued to sabotage the four pillars of democracy – Legislative, Executive, Judiciary and Media posing a big threat to the veritable structure of democracy. Aam Aadmi Party will continue to fight this crony capitalism of the worst kind where people holding the highest office had been hand in glove in manipulating Government machinery to build up huge assets and wealth for private firms owned by them and their benamies.
