JUSTICE GANGULY’S TORMENTOR INTERN NOT READY TO TESTIFY

Seven months after a law intern came out with sensational allegation against former Supreme Court Judge AK Ganguly of “unwelcome behaviour”, forcing him to resign as head of the West Bengal Human Rights Commission, the Delhi Police has not been able to record her statement due to non-cooperation on her part.
The Delhi Police has informed the Home Ministry that the law intern was not cooperating with the probe and the available material in the public domain on the controversy was not a sufficient to proceed against the retired judge.
In a letter to BJP leader Subramanian Swamy, the Home Ministry has said that, “The Delhi Police has intimated that after the matter was reported in the media on December 6, 2013, the law intern was again approached by the Delhi Police to indicate a suitable time and place as per her convenience for recording her account of the incident. To this she had replied on December 7, that she was travelling and would indicate a convenient time and place after she returns to Bangalore.”
The Home Ministry was responding to Swamy’s letter to then Prime Minister Manmohan Singh on December 23 seeking his intervention in the matter to stop the witch-hunt against Justice Ganguly.
“The Delhi Police added that the available material in the public domain on the issue did not disclose sufficient ground to proceed with the filing of FIR under Section 154 of CrPC. The Delhi Police has further informed that in spite of the repeated requests, the woman complainant has not joined the enquiry and hence no further enquiry into the incident of alleged unwelcome behaviour of the former Supreme Court Judge was possible. However, as and when the complainant comes forward to join the enquiry, necessary action shall be taken in the matter,” the Home Ministry said in a letter dated July 2.
The heated controversy had forced Ganguly to resign from the post of Chairperson of West Bengal’s Human Rights Commission. He was hounded by media and West Bengal Chief Minister Mamata Banerjee even wrote to President Pranab Mukherjee against him. Ganguly invited wrath of Banerjee for passing several orders against the State Government on a series of human rights violations. Ganguly was also part of the Bench headed by Justice GS Singhvi, which handled the 2G scam cases, leading to the cancellation of all the tainted telecom licences.
