Edward Keventor (Successors) Private Limited takes ex-party stay on CIC-verdict directing complete details of land-use change in Diplomatic Enclave (New Delhi)
It refers to CIC-verdict dated 03.12.2013 in appeal-number CIC/VS/A/2013/000256/05604 where Central Information Commissioner Vijai Sharma directed Union Ministry of Urban Development (MoUD) to provide complete and detailed information on land-use change allowed from Dairy Farm to Residential Group Housing for property situated at Block No.48, Diplomatic Enclave, Sardar Patel Marg, New Delhi-110021 where media-reports indicated about serious security concerns raised by Rashtrapati Bhawan, Intelligence bureau, Prime Minister’s Office (PMO) and others concerned because of big 22-acre plot of land in close vicinity to Rashtrapati Bhawan.
I regularly chased ministry through telephone-calls when they continuously and most humbly kept on pleading to wait for some more days. Ultimately I had to make my submissions to CIC (copy sent to MoUD through PG-portal vide registration-number DOURD/E/2014/00277) on 04.03.2014. But soon after Edward Keventer (Successors) Private Limited (and not MoUD) obtained an ex-party stay-order on the CIC-verdict on 06.03.2014 in presence of lawyer from MoUD also in the court. No notice was however given to the undersigned petitioner. Enquiry is necessary into dubious role of MoUD which avoided complying with CIC-verdict even much after expiry of time-limit to give private company sufficient time to approach courts for challenging the CIC-verdict. It is significant that lawyer of MoUD was somehow present in the court when the matter came for hearing.
