In a curious development in the National Herald case, Congress President Sonia Gandhi and son Rahul Gandhi on Wednesday approached the Delhi High Court for shifting the case before Justice Sunil Gaur, the second judge, who was recently shifted from the hearing.The politically sensitive case is now handled by Justice PS Teji, the third judge, who has started hearing the case since last week. The next hearing in the case is on Thursday when this petition will come up before Justice Teji.

"At the outset, it is categorically submitted that the petitioner has no difficulty in the matter being taken up by any Judge of this court for expeditious disposal. However, the petitioner is equally constrained to point out that this particular matter has been meted out a different treatment than ordinary cases," said Sonia and Rahul in their petition.
During the last hearing on October 8, Justice Teji had rejected the argument of Kapil Sibal, who was representing Sonia, for postponing the case to November. Observing that further delays were not allowed in the case, the judge insisted that Sibal had to argue next week - October 15.
Reacting to the development, BJP leader Subramanian Swamy, the main complainant in the case, said the Congress leaders were trying all tricks to delay the court proceedings. "Why these people did not petition when the first judge left the case? They know time is running out for them and so they are playing such tricks," said Swamy. Justice VP Vaish was the first judge in the case. He recused in January even after ordering a daily hearing in matter.
